TERMS AND CONDITIONS: SPAR 20‌19 Q2 TABLE TENNIS – STAND A CHANGE TO WIN A TABLE TENNIS TABLE TO THE VALUE OF R3 000 EACH

Please read these terms and conditions carefully. Participation in this Promotion will constitute your agreement to comply with these Terms and Conditions. If you do not agree with these Terms and Conditions, please do not participate. The Terms and Conditions set out below apply to all participants submitting entries for the Mondelez 2019 Q2 TABLE TENNIS. Please refer to Cadbury.co.za for the current Terms and Conditions for this Promotion

  1. THE PROMOTION:

    Cravings for Cash (“Promotion”) conducted by Mondelez South Africa (PTY) ltd., 6 Woodmead Estate, 1 Woodmead drive, Sandton, 21‌91. Tel: 01‌12‌53‌400‌0 (“The Promoter”)

  2. PROMOTION PERIOD
    1. The promotion will run from the 1st April 2019 until the 3‌1st May 2‌01‌9 (“The Promotional Period). No entries received after COB on the 31st of May will be accepted
    2. The duration of the Promotion may be extended or curtailed at the discretion of the Promoter
  3. WHO MAY ENTER
    1. All Participants must:
      1. a) be a natural person and be at least 18 (eighteen) years of age at the date of entry.
      2. b) be a citizen of the Republic of South Africa and/or legal resident of the country.
      3. c) be in possession of a valid South African Identity Document, resident/work permit and/or Driver’s License.
      4. d) have an active South African bank account in their own name
    2. Participation in the Promotion excludes directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of the Promoter, their Agencies, organisers and participating stores of the Promotion and the spouse, life partner, parent, child, brother, sister business partner or associate of any of the said persons.
  4. HOW TO QUALIFY FOR THE PROMOTION
    1. To qualify for the Promotion, each participant must purchase any 3 (three) of the individual units of any of the products listed below at a participating Spar store:

      2. CADBURY 40G CRUNCHIE CHOCOLATE
      3. CADBURY 48G LUNCHBAR ORIGINAL
      4. CADBURY 48G LUNCHBAR DREAM

    2. How to enter; buy any three of the participating products at a participating Spar store, fill in your name and contact number on your Spar till slip and submit their entry in the entry box provided in store. The store will contact the finalist on the mobile number provided once they have been drawn.
    3. Participants must enter with a mobile number that is owned by themselves. Participants may be asked to provide proof of ownership of said mobile number. If a Participant is requested to provide proof of ownership and is unable to, the Participant may be disqualified, at the sole discretion of the Promoter.
    4. The Promoter is not responsible for any incorrect or illegible mobile numbers on drawn entries and a new finalist will be selected. The Promoter is not responsible for any lost or stolen entries.
  5. CAN I QUALIFY MORE THAN ONCE FOR THE PROMOTION?
    1. Multiple entries will be permitted but will be limited to 3 (three) entries within a 24 (twenty-four) hour period, subject to each entry being submitted separately and in accordance with entry requirements. Participants will be notified when they have reached their entry limit. Should there be any dispute in this regard, the Promoter’s decision will be final.
    2. A participant may not win more than one (1) prize within the Promotion Period. The Promoter reserves the right to withhold prizes from any such participant and to reclaim any such prize if a breach of this rule is subsequently discovered.
  6. PRIZES
    1. The Promotion will afford participants a chance to win: TT2000 MKII Table Tennis Table and Accessories, valued at R3000 each
    2. Prizes are not transferrable or exchangeable and may not be redeemed for cash or sold, and should they not be taken up for any reason, they shall be forfeited or be the subject of a separate draw or be allocated at the Promoters discretion to another winner.
    3. The prize winner must have all requirements as mentioned in section 3.1.
    4. The prizes are based on set preselected models, winners are not able to choose the model/features/specifications/colour of the prize/s and will accept the prize as is at their own risk. Promotional images are merely a representation of the prize and the actual prize may vary. The promoter reserves the right to substitute any of the prizes for a different model/brand of similar value.
    5. The immediate costs (such as the cost of the prize) shall be covered by the promoter, upon signing for the prize any further costs will pass to the winner (this includes but is not limited to insurance of the prize, maintenance, or replacement). Any risks in relation to the prizes will pass to the winner once signed for.
  7. AWARDING OF PRIZES
    1. Selection of winners will be done at the end of the competition where 200 (two-hundred) random correct entries will be selected and verified, one per participating Spar store. Winners will be contacted telephonically on the mobile number that they used to enter the competition.
    2. The first qualifying finalists will be contacted within 72 (seventy-two) hours of the draw. In the event that a finalist is not contactable for 3 (three) consecutive days (three contact attempts) then such finalist will forfeit their prize and the next qualifying finalist from the original draw will be contacted. The same process as described herein will be followed.
    3. All prize finalists will be subject to a verification process. Winners will be confirmed only once the verification process has been completed.
    4. The prize will be forfeited if the product purchase does not match the product entry in the drawn entry.
    5. The date and time reflected on the till slip must pre-date the drawn entry.
    6. Till slips that reflect a date and time post the drawn entry will be deemed invalid.
    7. Please note that no other Promoter products are eligible for this Promotion, other than those products mentioned above. The qualifying products are subject to availability at time of purchase.
    8. The Promoter reserves the right to carry out reasonable due diligence to confirm eligibility and help ensure that the use of any such person in advertising or publicity for the Promotion will not bring the Promoter or any of the Promoter’s brands into public disrepute, contempt, scandal or ridicule or reflect unfavourably on the Promotion as determined by Promoter in its sole discretion.
    9. The Promoter reserves the right to withdraw the prize and/or disqualify any participant/winner that may bring the Promoter brands into disrepute.
    10. The Promoters may refuse to award the prize to a participant if there is suspicion of any irregularities or fraudulent activities.
  8. INDEMNITY
    1. To the extent permitted by the Consumer Protection Act and any other applicable law:
      1. a) The participant and/or winner(s) hereby indemnifies the Promoter, its associated companies (directors, officers and employees) and third party agents involved in this promotion against any direct, indirect, special, incidental, consequential or punitive damages or loss of any kind regardless of how this was caused, and whether it arose under the law of contract or delict or otherwise, because of the participants entrance to the Promotion.
      2. b) The Promoter excludes all warranties (express or implied), representations and liabilities regarding this Promotion (other than for death or personal injury caused by its negligence and/or fraud).
    2. The Promoter reserves the right, at any time, to verify the validity of participants (including but not limited to a participant’s identity, age and place of residence) and to reject any participant who has not complied with these
    3. Terms and Conditions. Errors and omission may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
    4. Neither Promoter nor its agents or distributors will have any liability in relation to this Promotion.
    5. By participating in this Promotion, participants agree to allow marketing material to be sent to them from the Promoter during and after the Promotion Period. They also agree to having their Participants will have the option to Opt Out with every SMS received, with the exception of the first SMS.
  9. CONFIDENTIALITY
    1. Participants of this promotion are voluntarily providing their personal information to the Promoter, its associated agencies and the third-party service providers running the Promotion in conjunction with the Promoter.
    2. By entering this Promotion, participants authorize the Promoter to collect, store and use (not share) personal information of participants for communication or statistical purposes. Participants are entitled to decline any marketing communication and inform the Promoter in writing should the participant wish to be removed from all communication.
    3. By entering this Promotion, the participant consents that the Promoter may use names and images taken of the winners/participants for publicity purposes, without any further remuneration being payable to the winner. All promotional material will become the sole property of the Promoter. However, the participant/winner has the right to decline participating in any promotional activity or to object to these images being used by written notification to the Promoter at 6 Woodmead Estate, 1 Woodmead Drive, Woodmead, Sandton, 2191, Attention: Legal Department. The written notification is to reach the Promoter by no later than the last stipulated draw da‌te.
  10. GENERAL
    1. The Promoter reserves the right to amend, modify, change, postpone, suspend or cancel this Promotion and any prizes, or any aspect thereof, without notice at any time, for any reason that the Promoter reasonable deems necessary.
    2. The onus rests on the participants to check the website for updates to the Terms and Conditions.
    3. No liability shall lie on the Promoter in favour of any participant, winner(s) and/or third party arising from such cancellation, suspension or termination. Therefore, the participant waives his/her right which they may have against the Promoter and hereby acknowledges that they will have no right of recourse or claim of any nature whatsoever against the Promoter.
    4. The Promoters decision is final, and no correspondence will be entered into.
    5. In part or all of any clause of these Terms and Conditions is illegal, invalid or enforceable:
      1. a) It will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible;
      2. b) It will be severed from these Terms and Conditions and the remaining provisions of these Terms and Conditions will continue to have full force and effect.
    6. Any dispute with number ownership (such as more than one individual claiming to be the owner of the same mobile/ contact number – verbally or otherwise) will result in immediate disqualification of both the number and the individuals and no negotiations will be entered into.
    7. All terms and conditions are subject to the laws of Republic of South Africa and should a doubt or dispute occur, it will be taken before the courts of Republic of South Africa.
    8. This Promotion is not applicable in conjunction with any other offers/ promotions offered by the Promoter.
