Cadbury Eggstraordinary Easter Promotion ("Terms and Conditions")


Please read the Terms and Conditions carefully. Participation in this Promotion will constitute your agreement to comply with the Terms and Conditions. If you do not agree with the Terms and Conditions, please do not participate.

The Terms and Conditions set out below apply to all participants submitting entries for the Eggstraordinary Easter Promotion ("Promotion").

  • 1. THE PROMOTION:

    The Promotion is conducted by Mondelez South Africa (Pty) Limited, 6 Woodmead Estate, 1 Woodmead Drive, Woodmead, Sandton, 2191, South Africa, Tel: 011 253 4000 ("Promoter").
  • 2. PROMOTION PERIOD

    • 2.1. The Promotion will run from 11 March 2019 to 12 April 2019 (“Promotion Period”). No entries received after midnight on 12 April 2019 will be accepted.
    • 2.2. The Promotion Period may be extended or curtailed at the discretion of the Promoter.
    • 2.3. The Promoter accepts no responsibility for any entries, which are delayed or not received due to any error, omission, delay in operation, transmission, network or software problems or any other reason beyond the Promoter's control.
  • 3. WHO MAY ENTER

    • 3.1. All participants must:
      • a. be a natural person and be at least 18 (eighteen) years of age at the date of entry.
      • b. be a citizen of Republic of South Africa and/or legal resident of the country.
      • c. be in possession of a valid South African identity document, resident/work permit and/or driver’s licence.
    • 3.2. The Promotion is not open to employees (or members of their immediate families namely sons, daughters, mothers, fathers, brothers, sisters, or spouses) of the Promoter, their subsidiaries, affiliates, sister companies or any third parties involved in the execution of the Promotion, either directly or indirectly. If any such person wins the Promotion, the Promoter reserves the right to cancel such participation.
    • 3.3. Participation in the Promotion constitutes acceptance of these terms and conditions, which the Promoter reserves the right to amend, alter or add to at any time during the term of the Promotion.
  • 4. HOW TO QUALIFY FOR THE PROMOTION

    • 4.1. To qualify for the Promotion, participants must register before locating a stash of Cadbury eggs on the map hosted on the campaign page and submit their entry details for a chance to win a weekly prize.
    • 4.2. Participants must locate all 5 (five) stashes of Cadbury eggs to qualify for the 6th (sixth) and final egg hunt and the associated grand prize.
    • 4.3. The Promoter shall not be responsible for any network costs or telecommunication failure on the part of the participant’s service provider.
    • 4.4. If registering via social media, participants must enter from a Facebook or Twitter account that is owned by themselves. No other person can use another person’s Facebook or Twitter account for competition entry purposes. This is to avoid fraud and possible litigation between the social media account owner and the entrant. Participants using a Facebook or Twitter account other than their own for the purpose of entry shall be disqualified and requested to refund the prizes to the Promoter, at the sole discretion of the Promoter.
  • 5. CAN I QUALIFY MORE THAN ONCE FOR THE PROMOTION?

    • 5.1. Multiple entries will be permitted subject to each entry being submitted separately and in accordance with entry requirements.
    • 5.2. A person may not win more than one prize within the Promotion Period. The Promoter reserves the right to withhold prizes from any such person and to reclaim any such prize if a breach of this rule is subsequently discovered.
    • 5.3. The Promoter reserves the right to withhold prizes from any participant and to reclaim prizes if a breach of any rule is subsequently discovered.
  • 6. PRIZES

    • 6.1. The Promotion will afford participants the opportunity to win:
      • 6.1.1. A weekly prize of 1 (one) Cadbury Easter egg hamper consisting of Cadbury Fluffies, Cadbury Hollow Eggs filled with Astros and Cadbury Hollows Eggs filled with Whispers.
      • 6.1.2. A grand prize of 1 (one) 2-night package at a 3-star, 4-star or 5-star lodge, resort or hotel for 4 (four) people sharing, tailored to the family size and location of the winner.
    • 6.2. Prizes are not transferrable or exchangeable and may be forfeited or be the subject of a separate draw or be allocated at the Promoter’s discretion to another winner.
    • 6.3. Prizes will be delivered to the winner. The Promoter will not be held liable for a prize sent to the wrong address as the address information will be supplied by the participant.
    • 6.4. All prize finalists will be subject to a verification process. Winners will be confirmed only once the verification process has been completed.
    • 6.5. The grand prize package may be booked up until 30 November 2019 subject to availability.
    • 6.6. The grand prize winner will be required to sign an indemnity form upon redemption of the prize.
    • 6.7. The grand prize package includes (subject to the package fitting into the R30 000 prize budget):
      • 6.7.1. 2 (two) nights’ accommodation for 4 (four) people sharing in a family room or similar based on venue availability.
      • 6.7.2. Bed and breakfast.
      • 6.7.3. Meal allowance (not included with full board packages and is venue dependent).
      • 6.7.4. If the winner opts for a venue in a different region, flights will be worked into the package (major city airport departures only). Subject to availability and provided it fits into the budget.
      • 6.7.5. If the winner opts for a self-drive package, then the package will include a travel allowance and additional activities (such as game drives) where available.
      • 6.7.6. Family games or activities including Pictionary, Twister, Uno Spin or standard Uno, Shuffle Monopoly Deal and Jenga.
      • 6.7.7. Packages will be customised according to the winner within the R30 000 budget. Packages will either be put together near to where the winner lives or in a specific region/area he/she may request. The inclusions will however be dependent on the available venues and total package cost (for example, some items may be excluded should the package not fall within the budget due to flight prices).
    • 6.8. The grand prize package excludes:
      • 6.8.1. Any items of a personal nature.
      • 6.8.2. All meals and drinks not mentioned above.
      • 6.8.3. Travel insurance.
    • 6.9. Redemption of the grand prize is subject to the following booking terms:
      • 6.9.1. The winner is to provide the booking agent with their preferred location for the weekend away. Based on this the available venues and package types will be provided to the winner to choose from. Bookings will only be made with the booking agent’s reputable suppliers; specially requested venues and special outlying or remote areas may be rejected based on this prefix.
      • 6.9.2. All packages are subject to the package fitting into the R30 000 prize budget. Any unforeseen price increases with venues/suppliers will result in a package being adjusted accordingly to fit within the budget (for example some items may be removed from the inclusions).
      • 6.9.3. Please note that all bookings are to be made before 31 May 2019. Bookings may be made for a later/advance date (up to November 2019) but are to be finalised within 6 weeks of being notified of being a winner.
      • 6.9.4. Booking requests to be made a minimum of 2 (two) weeks before your preferred booking date.
      • 6.9.5. School holidays and peak seasons are subject to availability and subject to the package remaining within the R30 000 prize budget. Should the peak season rates cause the package to exceed R30 000 in value, new dates will be requested or certain inclusions removed.
      • 6.9.6. Packages subject to seasonal adjustments, currency fluctuations, and accommodation availability at the time of booking.
      • 6.9.7. Please note: the winner is to provide 3 (three) possible booking dates along with their chosen package after receiving this list of options, in order for the booking to be processed. Should the preferred date be unavailable, the second date will be used, and so on, until a booking is finalised. No changes to the package or dates will be made once the booking is finalised.
      • 6.9.8. Flights and transfers quoted separately based on departure destination and arrival destination. The package may be adjusted to accommodate any excess in flight fees. The total package price (including flights) may not exceed R30 000.00. Flights included cover Cape Town, Durban and Johannesburg.
      • 6.9.9. Self-drive packages do not include transport or flights to the chosen venue. Transport is the winner’s responsibility and is to be taken into consideration when choosing the preferred destination. A travel allowance will be included to be used towards petrol or public transport.
      • 6.9.10. The travel allowance and meal allowance (where applicable) will be paid into the winner’s South African bank account 24 hours before their arrival at the venue via EFT based on the banking details provided in writing. The meal allowance is subject to the venue not providing full or half board where meals are already included in the package. Should the venue provide a half or full board service the meal allowance budget will be allocated directly to the venue to cover the full board costs.
      • 6.9.11. The package is for a family of 4 (four) made up of 2 (two) adults and 2 (two) children. Should the winner’s family consist of more people or different ages, for example 3 (three) children and 2 (two) adults, or 4 (four) adults, the package will be customised to include the additional people or the full rates charged for adults. The additional costs may result in items being excluded from the package to cover these costs.
      • 6.9.12. Should the winner not attend the venue on the confirmed booking date the booking will be cancelled and the prize forfeited.
      • 6.9.13. Packages do not include bar tabs or mini bar fees charged on departure. These costs are for the winner’s own account if applicable.
  • 7. AWARDING OF PRIZES

    • 7.1. Participants will be notified within the entry session via a social media direct message.
    • 7.2. Winners will then be notified via telephone. In the event that a finalist is not contactable for 3 (three) consecutive days (3 contact attempts), then such finalist will forfeit his/her prize, and another finalist will be randomly selected, and the same process as described herein will be followed.
    • 7.3. It may take up to 5 (five) business days for the prize to be delivered.
    • 7.4. The Promoter reserves the right to carry out reasonable due diligence to confirm eligibility and may refuse to award the prize to a participant if there is suspicion of any irregularities or fraudulent activities.
    • 7.5. The Promoter reserves the right to withdraw the prize and/or disqualify any participant/winner that may bring the Promoter’s brands into disrepute.
    • 7.6. The Promoter may refuse to award the prize to a participant if there is suspicion of any irregularities or fraudulent activities.
    • 7.7. Any dispute with the social media account ownership (such as more than one individual claiming to be the owner of the same social media account, verbally or otherwise) will result in immediate disqualification of both entries and the individuals, and no negotiations will be entered into.
    • 7.8. All prize winners will be contacted within 72 (seventy-two) hours of being drawn.
    • 7.9. If for any reason the Promoter cannot provide the winner with the prize because of any delays or changes beyond the Promoter’s control, the winner will be compensated with an alternative prize reasonably considered of equal value.
  • 8. INDEMNITY

    • 8.1. To the extent permitted by the Consumer Protection Act and any other applicable law:
      • 8.1.1. The participant and/or winner(s) hereby indemnify the Promoter, its associated companies (directors, officers and employees) and agents against any direct, indirect, special, incidental, consequential or punitive damages or loss of any kind regardless of how this was caused, and whether it arose under the law of contract or delict or otherwise, because of the participant’s entrance to the Promotion.
      • 8.1.2. The Promoter excludes all warranties (express or implied), representations and liabilities regarding the Promotion (other than for death or personal injury caused by its negligence and/or fraud).
      • 8.1.3. The Promoter reserves the right, at any time, to verify the validity of participants (including but not limited to a participant’s identity, age and place of residence) and to reject any participant who has not complied with these Terms and Conditions. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
      • 8.1.4. Neither the Promoter nor its agents or distributors will have any liability in relation to the Promotion.
      • 8.1.5. By participating in the Promotion, participants agree to allow marketing material to be sent to them from the Promoter during and after the Promotion Period. Participants will have the option to opt out with every SMS or email received, with the exception of the first SMS and email.
      • 8.1.6. The Promoter reserves the right to carry out reasonable due diligence to confirm eligibility and help ensure that the use of any such person in advertising or publicity for the Promotion will not bring the Promoter or any of the Promoter’s brands into public disrepute, contempt, scandal or ridicule or reflect unfavourably on the Promotion as determined by the Promoter in its sole discretion.
  • 9. CONFIDENTIALITY

    • 9.1. Participants of the Promotion are voluntarily providing their personal information to the Promoter, its associated agencies and the third-party service providers running the Promotion in conjunction with the Promoter.
    • 9.2. By entering the Promotion, participants authorise the Promoter to collect, store and use (not share) personal information of participants for communication or statistical purposes. Participants are entitled to decline any marketing communication and inform the Promoter in writing should the participant wish to be removed from all communication.
    • 9.3. By entering the Promotion, the participant consents that the Promoter may use names and images taken of the winners/participants for publicity purposes, without any further remuneration being payable to the winner. All promotional material will become the sole property of the Promoter. However, the participant/winner has the right to decline participating in any promotional activity or to object to these images being used by written notification to the Promoter at 6 Woodmead Estate, 1 Woodmead Drive, Woodmead, Sandton, 2191, South Africa. Attention: Legal Department. The written notification is to reach the Promoter by no later than the last stipulated draw date.
  • 10. GENERAL

    • 10.1. The Promoter reserves the right to amend, modify, change, postpone, suspend or cancel the Promotion and any prizes, or any aspect thereof, without notice at any time, for any reason that the Promoter reasonably deems necessary.
    • 10.2. The onus rests on the participants to check the website for updates to the Terms and Conditions.
    • 10.3. No liability shall lie on the Promoter in favour of any participant, winner(s) and/or third party arising from such cancellation, suspension or termination. Therefore, the participant waives his/her right which he/she may have against the Promoter and hereby acknowledges that he/she will have no right of recourse or claim of any nature whatsoever against the Promoter.
    • 10.4. The Promoter’s decision is final, and no correspondence will be entered into.
    • 10.5. The Promotion is in no way sponsored, endorsed or administered by or associated with Facebook and Twitter.
    • 10.6. If in part or all of any clause of the Terms and Conditions is illegal, invalid or enforceable:
      • 10.6.1. It will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible,
      • 10.6.2. It will be severed from the Terms and Conditions, and the remaining provisions of the Terms and Conditions will continue to have full force and effect.
    • 10.7. All Terms and Conditions are subject to the laws of Republic of South Africa, and should a doubt or dispute occur, it will be taken before the courts of Republic of South Africa.
    • 10.8. The Promotion is not applicable in conjunction with any other offers/promotions offered by the Promoter.
