TERMS AND CONDITIONS: Cadbury Eggstraordinary Easter Promotion

The Terms and Conditions set out below apply to all participants submitting entries for the Cadbury Eggstraordinary Easter Promotion ("the Promotion"). Please refer to the below website page for the current Terms and Conditions for this Promotion:

Please read the Terms and Conditions carefully. Participation in this Promotion will constitute your agreement to comply with the Terms and Conditions. If you do not agree with the Terms and Conditions, please do not participate.

 

  1. THE PROMOTION AND PROMOTER:

    The Promotion is conducted by Mondelez South Africa Proprietary Limited, 6 Woodmead Estate, 1 Woodmead Drive, Woodmead, Sandton, 2191, South Africa, Tel: 011 253 4000 ("the Promoter").

  2. PROMOTION PERIOD
    1. The Promotion will run from 20 March to 09 April 2020 ("the Promotional Period"). No entries received after 23h59 on 09 April 2020 will be accepted.
    2. The Promotional Period may be extended or curtailed at the discretion of the Promoter.
  3. WHO MAY ENTER
    1. All Participants in the Cadbury Eggstraordinary Easter Promotion ("Participants") must, at the time of entering the Promotion:
      1. a) be a natural person and be at least 18 (eighteen) years of age;
      2. b) be a citizen and legal resident of the Republic of South Africa;
      3. c) be in possession of a valid South African identity document, resident/work permit and/or driver's licence;
      4. d) be residing or be present in South Africa for the duration of the Promotional Period and for the period during which the prize draws and the delivery or collection of the prize/s takes place.
    2. Participation in the Promotion excludes directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of the Promoter or any third parties involved in the execution of the Promotion, either directly or indirectly (including but not limited to agencies, organisers and/or participating stores of the Promotion) as well as the members of the immediate family (being spouses, life partners, parents, children, brothers, sisters, fathers and/or mothers) and/or business partners or associates of any of the aforesaid persons.
  4. HOW TO PARTICIPATE IN THE PROMOTION:
    1. To qualify for the Promotion, Participants must register and submit their details when locating a Cadbury egg on the Facebook Instant Experience for a chance to win a weekly prize. The Facebook Instant Experience will either be:
      1. Served as an ad unit
      2. Be accessible through a link on the Cadbury Dairy Milk ZA Facebook page

      The user will need to enter the Instant Experience and navigate through the page to register for the competition, collect eggs, and find the jackpot stash.
    2. Participants must locate all 4 individual Cadbury eggs as well as the jackpot stash to qualify for the associated grand prize.
    3. The Promoter shall not be responsible for any network costs or telecommunication failure on the part of the Participant's service provider.
    4. Participants must enter from a Facebook account that is owned by themselves. No other person can use another person's Facebook account for competition entry purposes. This is to avoid fraud and possible litigation between the social media account owner and the entrant. Participants using a Facebook account other than their own for the purpose of entry shall be disqualified and requested to refund the prizes to the Promoter, at the sole discretion of the Promoter.
  5. CAN I QUALIFY MORE THAN ONCE FOR THE PROMOTION?
    1. Multiple entries will be permitted subject to each entry being submitted separately and in accordance with entry requirements.
    2. A person may not win more than one prize within a 6 (six) month period following his/her first win, nor shall (i) any member of such person's family (including, but not limited to, aunts, uncles, cousins, grandparents, in-laws, etc.) or (ii) friends or acquaintances residing at the same address, on the same property (including communes), or within a 2km radius of one another, qualify to win
    3. The Promoter reserves the right to withhold prizes from any such Participant and to reclaim prizes if a breach of any rule is subsequently discovered or suspected.
  6. PRIZES:
    1. The Promotion will afford Participants the opportunity to receive:
      A weekly prize of either:
      1.   Takealot Vouchers: 1 (one) of 100 x R 100 vouchers
      2.   Superbalist Vouchers: 1 (one) of 50 x R 200 vouchers
      3.   Cadbury Hampers: 1 (one) of 20
    2. Winners will accept the prize at their own risk.
    3. Vouchers are valid for 3 years from the date of generation (1 February 2020). No expired vouchers will be replaced, and winners are to take note of the expiry date.
    4. A grand prize of:
      1.   1 (one) of 3 (three) x 2-night packages at a 3-star, 4-star or 5-star lodge, resort or hotel for 4 (four) people sharing, tailored to the family size and location of the winner, not exceeding R10 000 in value.
    5. Prizes are not transferrable or exchangeable and may be forfeited or be the subject of a separate draw or be allocated at the Promoter's discretion to another winner.
    6. Prizes will be delivered to the winner. The Promoter will not be held liable for a prize sent to the wrong address as the address information will be supplied by the participant.
    7. Any risks in relation to the prizes (such as loss, theft or damages) will pass to the winner once the prize has been delivered/accepted and/or the delivery waybill signed. No lost or stolen vouchers will be replaced.
    8. Prizes are not transferrable or exchangeable and shall not be redeemed for cash and if not taken up for any reason, they shall be forfeited or be the subject of a separate draw or be allocated at the Promoters' discretion to another winner.

    11. The grand prize packages may be booked for travel not departing later than 30 November 2020 subject to availability.
    12. The grand prize winners will be required to sign an indemnity form upon redemption of the prize.
    13. The grand prize packages include (subject to the package fitting into the R10 000 prize budget):
      1.   2 (two) nights' accommodation for a family of 4 (four) people sharing in a family room or similar based on venue availability.
      2.   Bed and breakfast.
      3.   Packages will be customised according to the winner within the R10 000 budget.
      4.   Packages will either be put together near to where the winner lives or in a specific region/area he/she may request. The inclusions will however be dependent on the available venues and total package cost
    14. The grand prize travel packages exclude: Any items of a personal nature. All meals and drinks not mentioned in the package description. Travel insurance.
    15. Redemption of the grand prize is subject to the following booking terms:
      1.    The winner is to provide the booking agent with their preferred location for the weekend away. Based on this the available venues and package types will be provided to the winner to choose from. Bookings will only be made with the booking agent's reputable suppliers; specially requested venues and special outlying or remote areas may be rejected based on this prefix.
      2.    All packages are subject to the package fitting into the R10 000 prize budget. Any unforeseen price increases with venues/suppliers will result in a package being adjusted accordingly to fit within the budget (for example some items may be removed from the inclusions).
      3.    Please note that all bookings are to be made before 31 May 2020. Bookings may be made for a later/advance date (up to November 2020) but are to be finalised within 6 weeks of being notified of being a winner.
      4.    Booking requests to be made a minimum of 2 (two) weeks before your preferred booking date.
      5.    School holidays and peak seasons are subject to availability and subject to the package remaining within the R10 000 prize budget. Should the peak season rates cause the package to exceed R10 000 in value, new dates will be requested, or certain inclusions removed.
      6.    Packages subject to seasonal adjustments, currency fluctuations, and accommodation availability at the time of booking.
      7.    Please note: the winner is to provide 3 (three) possible booking dates along with their chosen package after receiving the options, in order for the booking to be processed. Should the preferred date be unavailable, the second date will be used, and so on, until a booking is finalised. No changes to the package or dates will be made once the booking is finalised.
      8.    Packages do not include transport or flights to the chosen venue. Transport is the winner's responsibility and is to be taken into consideration when choosing the preferred destination.
      9.    The travel allowance (where applicable) will be paid into the winner's South African bank account 24 hours before their arrival at the venue via EFT based on the banking details provided in writing.
      10.    The package is for a family of 4 (four) made up of 2 (two) adults and 2 (two) children. Should the winner's family consist of more people or different ages, for example 3 (three) children and 2 (two) adults, or 4 (four) adults, the package will be customised to include the additional people, or the full rates charged for adults. The additional costs may result in items being excluded from the package to cover these costs.
      11.    Should the winner not attend the venue on the confirmed booking date the booking will be cancelled, and the prize forfeited.
      12.    Packages do not include bar tabs, room service, in-room entertainment or mini bar fees charged on departure. These costs are for the winner's own account if applicable.
  7. AWARDING OF PRIZE:
    1. Participants will be notified within the entry session via a randomised modal landing page.
    2. Winners will then be notified via Facebook. In the event that a finalist is not contactable for 3 (three) consecutive days (3 contact attempts), then such finalist will forfeit his/her prize, and another finalist will be randomly selected, and the same process as described herein will be followed.
    3. It may take up to 5 (five) business days for the prize to be delivered.
    4. The Promoter reserves the right to extend the delivery period should the necessity arise.
    5. The Promoter reserves the right to carry out reasonable due diligence to confirm eligibility and may refuse to award the prize to a participant if there is suspicion of any irregularities or fraudulent activities.
    6. The Promoter reserves the right to withdraw the prize and/or disqualify any participant/winner that may bring the Promoter's brands into disrepute.
    7. The Promoter may refuse to award the prize to a participant if there is suspicion of any irregularities or fraudulent activities.
    8. Any dispute with the social media account ownership (such as more than one individual claiming to be the owner of the same social media account, verbally or otherwise) will result in immediate disqualification of both entries and the individuals, and no negotiations will be entered into.
    9. All prize winners will be contacted within 72 (seventy-two) hours of being drawn.
    10. If for any reason the Promoter cannot provide the winner with the prize because of any delays or changes beyond the Promoter's control, the winner will be compensated with an alternative prize reasonably considered of equal value.
  8. GRAND TRAVEL PACKAGE PRIZES
    1. The Grand Travel Package Prize winners and their travel partners must be available to travel between 1 May 2020 and 30 November 2020 ("Travel Dates"). Should the winner be unavailable to take up the Trip Prize on the Travel Dates as provided and as determined by Promoters, the Winner and their travel partner will be deemed to have forfeited the Trip Prize. In such event the Trip Prize will revert to the Promoter.
    2. The Trip Prize is subject to successful application and issue of a Visa to the winner. If a winner's Visa application is declined or is unsuccessful for any reason whatsoever, the winner will forfeit the Trip Prize. In such event the Trip Prize will revert back to the Promoter.
    3. Should the winner of a Trip Prize wish to make any changes in any way whatsoever to the Trip Prize, other than what will be arranged by the Promoter, including Travel Dates and the number of travel partners, such costs, charges, expenses or any such adaptions or variations to the Trip Prize, will be subject to the Promotor's prior written consent and for the Trip Prize winners' own account.
    4. The Promoter will call the finalist and conduct a Promotion verification process ("Verification Process").
    5. The Verification Process will consist of the following:
      1. a) contacting the finalist and confirming that the finalist and their travel partner hold a valid South African Identity document AND valid passports; and
      2. b) the winner will be required to fill in a winner form and indemnity, which needs to be returned to the Promoter within 24 (twenty-four) hours.
      3. c) If the Promoter is unable to reach any Trip Prize winner after 3 (three) days from the date of being declared a winner, or if a Trip Prize winner fails the Verification Process for whatsoever reason after their entry is drawn, such person will be disqualified and a draw for a replacement Winner will take place.
      4. d) None of the Promotion prizes are transferable or redeemable for cash and the Promoter is not liable for any defect, changes and/or modifications in the Trip Prize.
      5. e) The Promoter reserve the right to substitute the Trip Prize with any other prize of comparable commercial value.
  9. INDEMNITY
    1. To the extent permitted by the Consumer Protection Act and any other applicable law:
      1. The Participant and/or winner(s) hereby indemnify the Promoter, its associated companies (directors, officers and employees) and agents against any direct, indirect, special, incidental, consequential or punitive damages or loss of any kind regardless of how this was caused, and whether it arose under the law of contract or delict or otherwise, because of the participant's entrance to the Promotion.
      2. The Promoter excludes all warranties (express or implied), representations and liabilities regarding the Promotion (other than for death or personal injury caused by its negligence and/or fraud).
      3. The Promoter reserves the right, at any time, to verify the validity of participants (including but not limited to a participant's identity, age and place of residence) and to reject any participant who has not complied with these Terms and Conditions.
      4. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
      5. Neither the Promoter nor its agents or distributors will have any liability in relation to the Promotion.
      6. By participating in the Promotion, participants agree to allow marketing material to be sent to them from the Promoter during and after the Promotion Period. Participants will have the option to opt out with every SMS or email received, with the exception of the first SMS and email.
      7. The Promoter reserves the right to carry out reasonable due diligence to confirm eligibility and help ensure that the use of any such person in advertising or publicity for the Promotion will not bring the Promoter or any of the Promoter's brands into public disrepute, contempt, scandal or ridicule or reflect unfavourably on the Promotion as determined by the Promoter in its sole discretion.
  10. CONFIDENTIALITY
    1. Participants of the Promotion are voluntarily providing their personal information to the Promoter, its associated agencies and the third-party service providers running the Promotion in conjunction with the Promoter.
    2. By entering the Promotion, participants authorise the Promoter to collect, store and use (not share) personal information of participants for communication or statistical purposes. Participants are entitled to decline any marketing communication and inform the Promoter in writing should the participant wish to be removed from all communication.
    3. By entering the Promotion, the Participant consents that the Promoter may use names and images taken of the winners/participants for publicity purposes, without any further remuneration being payable to the winner. All promotional material will become the sole property of the Promoter. However, the participant/winner has the right to decline participating in any promotional activity or to object to these images being used by written notification to the Promoter at 6 Woodmead Estate, 1 Woodmead Drive, Woodmead, Sandton, 2191, South Africa. Attention: Legal Department. The written notification is to reach the Promoter by no later than the last stipulated draw date.
  11. GENERAL
    1. The Promoter reserves the right to amend, modify, change, postpone, suspend or cancel the Promotion and any prizes, or any aspect thereof, without notice at any time, for any reason that the Promoter reasonably deems necessary.
    2. The onus rests on the participants to check the website for updates to the Terms and Conditions.
    3. No liability shall lie on the Promoter in favour of any participant, winner(s) and/or third party arising from such cancellation, suspension or termination. Therefore, the participant waives his/her right which he/she may have against the Promoter and hereby acknowledges that he/she will have no right of recourse or claim of any nature whatsoever against the Promoter.
    4. The Promoter's decision is final, and no correspondence will be entered into.
    5. The Promotion is in no way sponsored, endorsed or administered by or associated with Facebook.
    6. If in part or all of any clause of the Terms and Conditions is illegal, invalid or enforceable:
      1. It will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible,
      2. It will be severed from the Terms and Conditions, and the remaining provisions of the Terms and Conditions will continue to have full force and effect.
    7. All Terms and Conditions are subject to the laws of Republic of South Africa, and should a doubt or dispute occur, it will be taken before the courts of Republic of South Africa.
    8. The Promotion is not applicable in conjunction with any other offers/promotions offered by the Promoter.
